Terms of Service

1. Eligibility

You must be at least 13 years old to use Pins. By using the Service, you confirm that you meet this requirement.

2. User Accounts

• You must provide accurate and complete information when registering.
• You are responsible for safeguarding your account credentials.
• You are responsible for all activity under your account.

3. User Content

You may upload content (e.g., scores, photos, comments). You retain ownership, but grant us a license to host, display, and promote the Service.

Zero-tolerance policy. Pins has a zero-tolerance policy for objectionable content and abusive behavior. You may not post or share content that is unlawful, hateful, harassing, threatening, discriminatory, sexually explicit, violent, defamatory, infringing, or otherwise objectionable, and you may not use Pins to bully, harass, or abuse other users.

Moderation and removal. We reserve the right, at our sole discretion and without notice, to review, refuse, remove, or restrict any content we deem inappropriate or in violation of these Terms, and to suspend or terminate accounts of users who violate this policy. Reports of objectionable content or abusive users can be sent to clubhouse@pinsgolf.com and will be addressed within 24 hours.

4. Acceptable Use

You agree to use Pins responsibly and in compliance with these Terms and all applicable laws.

• Comply with the User Content standards in Section 3, including our zero-tolerance policy for objectionable content and abusive behavior.
• No unlawful, fraudulent, or unauthorized activity.
• No harassment, bullying, threats, hate speech, discrimination, or abuse of other users.
• No spam, scams, impersonation, or misleading conduct.
• No distribution of malware, viruses, or other harmful code.
• No reverse engineering, scraping, or unauthorized access to our app, systems, or data.
• No interference with the Service, servers, or networks.

5. Intellectual Property

Pins, including the app, website, brand, logos, designs, software, and all related content (excluding user content), is owned by Pins and protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

6. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe content on Pins infringes your copyright, please send a notice to clubhouse@pinsgolf.com with: (a) identification of the copyrighted work; (b) the location of the infringing material on Pins; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights holder; and (f) your physical or electronic signature. We may remove infringing content and terminate repeat infringers' accounts.

7. Indemnification

You agree to defend, indemnify, and hold harmless Pins, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) content you submit or share through the Service; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

8. App Store Terms

If you downloaded Pins from the Apple App Store, you acknowledge that these Terms are between you and Pins only, not with Apple, and that Apple is not responsible for the Service or its content. Your use of Pins must also comply with the Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Similar terms apply for any other app store or platform through which you access Pins.

9. Privacy

Our use of your data is governed by our Privacy Policy.

10. Subscription and Payments

If applicable: payments are non-refundable unless required by law. We may adjust pricing or features with notice.

11. Termination

We may suspend or terminate your access at any time. You can also delete your account whenever you like.

12. Disclaimer

Pins is provided "as is" with no warranties. We do not guarantee the accuracy of your stats or golf data.

13. Limitation of Liability

We are not liable for indirect or incidental damages related to your use of Pins, to the extent allowed by law.

14. Changes to These Terms

We may update these Terms. We'll notify users via email or in-app when material changes occur.

15. Governing Law

These Terms are governed by the laws of The Netherlands.
